Sacked traditional ruler appeals judgment

A traditional ruler in Oyo State, Oba Abdulateef, Olagoke, the Onilala of Lanlate, has approached the Court of Appeal, seeking to reverse the ruling of a state High Court, sitting in the Eruwa Judicial Division, which ordered him to vacate his stool.

Justice B. A. Taiwo had ruled that Oba Sunday Oladejo is reinstalled as the traditional ruler of the community, saying the Application Law used to fill the vacant stool of the Onilala of Lanlate in 2008 was the 2006 Declaration and not the 1958 Law.

However, spokesperson of the Bioku Royal Family, Omoba Jare Gbadamosi, said the family had filed an application before the Appeal Court to challenge the judgment of the lower court.

“It is true that the High Court of Oyo State ruled in favour of Sunday Bolawaye Oladejo in the Onilala of Lanlate chieftaincy dispute on the basis of a 2006 Declaration which is a product of an abrogated White Paper by the Oloko Commission of Inquiry as against the only valid and subsisting Chieftaincy Declaration of 1958.

“The Bioku Ruling House of Lanlate, whose candidate occupies the throne, has lodged an appeal at the Court of Appeal, Ibadan Division and the at same time filled an application for a stay of execution of the judgement.

“The court processes have been served on all parties to the suit. Therefore, the government and any party to a litigation must not do anything that will impede or frustrate the constitutionally guaranteed right of appeal.

“Until the appeal is determined, litigation is not at an end. Therefore, Abdulateef Olawuyi Olagoke remains the Onilala of Lanlate.

“The entire Lanlate Community should please remain calm and while we advised all parties involved to remain law-abiding and should not resolve to self-help that may lead to break of peace, law and order within Lanlate and its environ,” he said.
